Who we are and who this Policy covers

The Mound Method is a remote baseball pitching development service operated by Jack Brandon Priory, individually and doing business as The Mound Method. This Policy applies to themoundmethod.com, the training application, remote coaching, video analysis, electronic communications, and related services we provide.

For this Policy, "guardian" means the adult parent or legal guardian who creates and controls a family account. "Athlete" means the person receiving coaching. Most Athletes are minors. Minor Athletes do not create independent accounts.

The Mound Method is based in Statesville, North Carolina. Privacy requests may be sent to jbmbaseball@icloud.com.

Information we collect

Information provided by the guardian

  • Guardian account information: name, email address, optional phone number, account credentials handled by the authentication provider, and billing/account status.
  • Athlete information: name, age or age range when needed to determine eligibility and child-privacy requirements, training level, throwing hand, and information needed to personalize training.
  • Intake information: training goals, baseball schedule, relevant throwing workload, and other information the guardian chooses to provide.
  • Safety and workload information: games pitched, pitch counts, innings, bullpens, practices, camps, showcases, lessons or programs, school/travel/tournament activity, velocity programs, significant position-player throwing, soreness, fatigue, pain, injury information, medical restrictions, return-to-play restrictions, and relevant healthcare-provider recommendations when the family provides them for safe programming.
  • Communications: emails, texts, support requests, scheduling communications, and other messages sent to us.

We do not ask families to provide more medical information than is reasonably necessary for safe athletic programming. The Mound Method is not a healthcare provider and does not maintain medical records for diagnosis or treatment.

Information created through coaching

  • Training programs, daily sessions, exercises, prescriptions, and program adjustments.
  • Completion history and dates.
  • Optional session notes about how training felt.
  • Self-reported effort and soreness ratings.
  • Private coaching notes created by Jack Brandon Priory.
  • Submitted pitching, throwing, training, or workout video and related coaching feedback.

Soreness, effort, injury, restriction, and workload information is used as athletic training and safety feedback. It is not used to diagnose or treat a medical condition.

Information collected automatically

We intentionally minimize automatic collection. We do not use behavioral advertising, cross-site tracking, session replay, or fingerprinting. Our hosting and security providers may receive ordinary technical information needed to deliver and secure the Service, such as IP address, browser or device information, request time, and server logs.

Your device may store an authentication token or similar local-storage information to keep you signed in. We do not use that storage for advertising.

Information we do not receive directly

Passwords are handled by our authentication provider and are not visible to the coach. When third-party payment processing is enabled, full payment-card numbers are processed by the payment provider rather than stored by The Mound Method. If Google sign-in is offered and selected, we receive only the information disclosed in the sign-in flow, ordinarily name and email address.

How we use information

  1. Provide and personalize pitching programming, two monthly coaching calls, video analysis and coaching feedback, and administer optional in-person pitching lessons when purchased.
  2. Monitor training completion, workload, soreness, effort, and information the family provides so programming can be adjusted.
  3. Create, maintain, authenticate, secure, and support family accounts.
  4. Send account invitations, password-reset messages, service notices, billing communications, scheduling information, and coaching communications.
  5. Process or document parental permissions, participation agreements, waivers, and optional publicity choices.
  6. Protect the Service, investigate misuse, troubleshoot faults, maintain records, and comply with legal obligations.
  7. Respond to access, correction, deletion, portability, consent, and other privacy requests.

We do not sell personal information. We do not use personal information for targeted advertising. We do not build advertising profiles of Athletes. We do not use Athlete information to make automated decisions producing legal or similarly significant effects.

Children under 13 and parental consent

The Service accepts Athletes age 6 and older, so information may relate to children under 13. Family accounts are created and controlled by adults. We do not permit a child under 13 to create an independent account.

Before we knowingly collect personal information online directly from a child under 13 in a manner that requires consent under the Children's Online Privacy Protection Act ("COPPA"), we will provide the parent or legal guardian with the required direct notice and obtain verifiable parental consent using a method permitted by applicable law. The consent process will describe the information collected, how it is used, whether it is disclosed, and how the parent may review or delete it.

Information an adult voluntarily provides about the adult's child is handled under this Policy. If an Athlete under 13 is permitted to type a session note, submit information, communicate directly, or otherwise provide personal information through the online Service, that feature must be covered by the parent-notice and verifiable-consent process before collection unless a legal exception applies.

A parent may refuse or revoke consent, review personal information collected from the child, request correction or deletion, and refuse further collection or use. Revoking consent may require us to stop features that cannot operate without the information.

We do not condition a child's participation on providing more personal information than is reasonably necessary for the activity.

Video and photographs

Families may submit Athlete videos for private coaching, video analysis, mechanical evaluation, progress evaluation, program development, instruction, and administration. Private submission does not authorize public use.

We will not use an identifiable Athlete photograph, video, name, likeness, testimonial, or similar content for advertising, marketing, website, or social-media purposes without separate affirmative written authorization from the appropriate adult. Publicity consent is optional and may be withdrawn prospectively by written notice, subject to material already lawfully published or distributed.

Who receives information

Jack Brandon Priory may access family and Athlete information as reasonably necessary to coach and administer the Service. A guardian may access their own family information. Access controls are intended to prevent one family from accessing another family's account.

We may use service providers acting on our behalf. Providers may change as the Service evolves. The categories currently contemplated or used include:

Provider / CategoryPurposeInformation involved

Payment processor, when enabledPayment processing and billingBilling information needed by the processor; The Mound Method need not receive full card numbers
Electronic-signature provider, when enabledParticipation Agreement, waiver, consent, and signature recordsNames, signatures, initials, dates, form content, audit information

We require service providers to use information only for the services they provide to us and to protect it as required by applicable law and our agreements with them. For personal information collected online from children under 13, we will make required disclosures in the direct parental notice and obtain any separate consent required by COPPA before disclosure for a purpose that requires it.

We may also disclose information when reasonably necessary to comply with law or legal process; protect the rights, safety, or security of an Athlete, family, The Mound Method, or another person; investigate fraud or abuse; or complete a business transfer. If ownership of the business changes, personal information may transfer subject to this Policy and applicable law.

Cookies, local storage, and similar technology

The Service does not use advertising or behavioral-analytics cookies. Authentication may use local storage, cookies, or similar technology strictly to sign users in, maintain sessions, prevent abuse, or provide requested functionality. Essential technologies may operate without a separate advertising consent because they are not used for behavioral advertising.

Third-party content-delivery services may receive technical request information when your device requests a software library, font, or other asset. We configure the Service to minimize unnecessary third-party collection, particularly for child users.

Data retention and deletion

We retain personal information only for as long as reasonably necessary for the purpose for which it was collected, to provide the Service, resolve disputes, maintain required business or legal records, enforce agreements, or satisfy applicable law. We do not retain children's personal information indefinitely.

InformationGeneral retention approach
Active account and training recordsWhile the account is active and reasonably needed for coaching. After cancellation, ordinarily deleted or de-identified within 30 days unless a longer period is reasonably necessary for a stated legal, safety, dispute, or recordkeeping purpose.
Private coaching notesKept while reasonably needed for coaching; ordinarily deleted with the account on the same post-cancellation schedule.
Submitted coaching videoKept only as long as reasonably necessary for coaching, progress comparison, administration, or an authorized purpose; deleted earlier upon a valid request unless retention is legally required.
Unused or expired invitations / uncompleted child-consent recordsDeleted when no longer reasonably needed, subject to security and legal-record requirements.
Signed Participation Agreements, waivers, consent records, and transaction recordsRetained for the period reasonably necessary to document consent, the parties' agreement, legal compliance, and potential claims, which may extend beyond account cancellation.
Server and security logsKept for a limited rolling period determined by the hosting/security provider and our security needs, unless needed longer to investigate an incident.

A parent or account holder may request earlier deletion. We will delete information that is no longer reasonably necessary unless retention is required or permitted for a legitimate legal purpose. When deletion is required, we use reasonable measures designed to securely delete or de-identify the information.

Security

  • Encryption in transit through HTTPS.
  • Authentication and access controls intended to limit family accounts to their own information.
  • Database-level access controls where supported by the service architecture.
  • Passwords handled by the authentication provider rather than exposed to the coach.
  • Reasonable restrictions on what application code may run and where data may be sent.
  • Use of service providers and administrative practices intended to protect confidentiality, integrity, and availability.

No security system can guarantee absolute security. If we determine that personal information has been compromised, we will investigate and provide notices required by applicable law.

Your privacy choices and rights

Subject to applicable law and reasonable identity/authority verification, an account holder or authorized parent or guardian may request to:

  • Know or access personal information we maintain about the family or Athlete, including private coaching notes where legally required.
  • Correct inaccurate information.
  • Delete personal information and close the account.
  • Receive available training history in a reasonably usable format.
  • Withdraw parental consent for future collection or use of a child's information.
  • Withdraw optional publicity authorization prospectively.
  • Ask questions about service providers, retention, or our privacy practices.

Send requests to jbmbaseball@icloud.com. We may need to verify that the requester is the account holder or legally authorized parent or guardian before disclosing or deleting a child's information. We will respond within the period required by applicable law and generally aim to respond within 30 days.

Depending on where you live, state privacy law may provide additional rights, including appeal rights. We will not discriminate against you for exercising a privacy right protected by law.

Communications with minor Athletes

A parent or legal guardian may authorize Jack Brandon Priory to communicate with a minor Athlete as reasonably necessary for baseball instruction, pitching feedback, scheduling, video analysis, and administration. For younger Athletes, communications should be parent-accessible or parent-involved whenever reasonably practicable. We do not use direct communications with minors for behavioral advertising or unrelated marketing.

United States service and data location

The Service is offered primarily to families in the United States. Account and training information is intended to be hosted in the United States where our configured providers offer U.S. hosting. Some infrastructure or content-delivery providers may operate global networks, so limited technical request data may be processed outside the United States. We do not intentionally send Athlete training records to a global content-delivery network merely to serve fonts or software assets.

Changes and contact

We may update this Policy as the Service, providers, or law changes. If a change materially affects what personal information we collect, how we use it, or who receives it, we will provide reasonable notice to account holders and obtain additional parental consent when required by law.
